Collaborative Family Law and Divorce

Just as the typical American family has changed in the last two decades, so has the area of family law. Every day at Kilcommons Shanahan, we bring a breadth of knowledge, experience and sensitivity to our clients in every case.
Collaborative Family Law
As a form of Alternative Dispute Resolution (ADR), Collaborative Family Law is an answer to address and ease the pain of divorce for all parties, and most importantly, the children. Based upon professional and personal experiences, Collaborative Law is a preferred method of alternative dispute resolution, and will prove to be a better foundation for raising children post-divorce.
The goal of the collaborative attorney is to assist the client in arriving at a fair and equitable settlement while maintaining civility, and both ex-spouses retaining enough mutual respect and trust to enable them to converse after the divorce, which is so critical when there are children to rear and child-rearing issues to resolve for perhaps years to come.
Mediation
The goal of our attorney mediator is to act as an objective, neutral third party in assisting the spouses in identifying issues requiring resolution. Mediation is more likely to be successful when both husband and wife are able to communicate their needs effectively and negotiate in good faith. Spouses are encouraged to retain attorneys with whom they may obtain advice specific to their circumstances, as the mediator is not permitted to give legal advice.
Divorce
Families are challenged by divorce issues such as:
Child support,
Alimony,
Custody, and
Related litigation such as domestic violence.
Increasingly complex family matters require the knowledge, experience and sensitivity that you will find at Kilcommons Shanahan.
